  • Sid is sooo in the dark with everything. First - he doesn't know that Emily is in Philly. And that she is in Philly with Taylor. Secondly - he knows there IS a Lucia, he just doesn't know who the father is - that He is the father. But everyone else does - his teammates, his sister - hell, even his parents know.

    And now all the drama with Taylor - she left school, she is in Philly and she is pregnant. Just wait till he finds out who the baby daddy is!!!

    My god when everything comes out, Sid's head is going to explode. And I can see him being really pissed off at everyone.

  • I know how Emily feels - she did what she thought was the right thing at the time (leaving when she was pregnant) - thinking the only person hurt in all this would be herself. But now she has realized that by leaving, she hurt all those people that loved her that she left behind. And with Layla, she doesn't have the opportunity to make it right.

    But she does have the opportunity to make it right with Sidney - and hopefully she will.

  • Just to clarify, there would be a record of Taylor entering the US if she drove as well. Going through the border, Canadian passports are scanned by the Border Officer, so that they know when and where people are entering the US.

    There are certainly a lot of issues with her being illegally in the US - but I think there are also many issues with the fact that she is only 16. As I mentioned before, to obtain her I-20 (to allow her access to the US as a student) she must have adequate health care coverage (pregnancy included). But depending upon the carrier, the money may have to be paid up front and then the carrier reimburses the claim. This would definitely cause a big issue for Taylor. Being a minor, she may even need a parent signature for the insurance claim.

    I would imagine that any credit cards she might have would be "companion" cards - her card on her parent's account. So her parents would be able to see the charges.

    I still wonder if there would be any legal repercussions with Taylor being so young and involved with a 24 year old man. That might even put Claude in legal hot water and HE not be allowed to stay in the US.

    I think there are a lot of great angles to investigate here - hope I didn't overload you!!

  • oh, and I totally understand that it's hard to correct a 'problem' in your writing when you weren't aware anything was wrong in the first place. So that's another reason why it can be a good idea to get a beta reader or two - extra eyes to say, 'heeeeeey, wait a minute - if X, then how can Y happen?'

    And she could have problems with money - accessing foreign banks, credit cards; if her name gets flagged as being here illegally, I can imagine that that's one way to trace and find an illegal alien. That's why so many illegals only use cash. You can't even get a bank account here if you're here illegally. I opened an account for a minor child, I needed to provide DOB, place of birth, and social sec. #s for me and child (also, previous addresses for the last 5 years for both) and they ran a background check on both me and the kid. (I asked, the bank manager said they're looking for people who aren't supposed to be here).

  • Depends on if she got caught or not. To enter the US from canada, one needs a passport. If she flew, there would be evidence of her entry into the States. If she drove, maybe yes, maybe no, from anecdotal description. Regardless, she cannot get a legal job. Once her 6 months are up, she's here illegally. If she had the baby here, she'd have to pay out of pocket for care ($$$ - for example, a routine, non-emergency vaginal hospital birth can easily run you $20K or if you don't have private insurance and that's the birth ALONE - not the dr. visits, the tests, the ultrasounds, etc) or go to free clinics as an illegal alien for care. As a minor, things are that much more difficult for, especially for an illegal. For example, to get a rental, you need to submit proof of income and landlords routinely do a background check (requiring a social security number).

    Honestly, I'd have to do a lot of research to know what would happen to a Canadian illegal, I don't have the personal knowledge. But what I do know is that if she got caught, she could be deported. And there could be some hefty fines assessed, maybe even jail time. She could be in trouble even from the IRS, depending on how her stay was funded. She could even possibly be in trouble in Canada once she returned there, too. Something about losing the free social medical care after a certain amount of time out of the country? And of course, if she gets in trouble staying here, she may never be able to come back legally. Illegal Aliens deported are ineligible for readmission to US under current laws, AFAIK. Hell, Emily could get in legal trouble if she housed or lived with taylor - it's illegal to harbor an illegal alien. I don't know if she could drive here, how she'd get car insurance, plates on a Canadian vehicle.

    I absolutely agree 10000% with both of you, you guys make amazing points. I do try to research as much as I can when writing a story b/c I don't want to come off like a moron, but the visa stuff hadnt actually crossed my mind until now :) so what would you say if someone from Canada was living illegally in america and had a baby, what would happen there? Iam definitely going to start editing chapters now and doing my research :)

  • I'm a pedant with a strong need to understand things. I admit freely that as a reader I will often research things I come across in stories to see if they're right or wrong if only so I can understand them. If something in a story contradicts what I know or believe to be true or true to my experience, I often check it out. So with your story, I knew that foreigners, even Canadians, are restrained by US law as to how and how long they can legally be here. I didn't know the exacts so I looked up all sorts of things on visas, what kind of visas there are, how long tourists can be here (no visa required), visa requirements, who can sponsor a foreigner, the conditions under which sponsorship can be extended, how Canadians access medical care in the US, etc etc.

    I need things to make sense, to be logical, to be understandable. I'm willing to suspend my disbelief for certain things I know not to be true if warned in advance. I know going into a vampire fic, for example, that I can't attribute human physical abilities or limits to the vamp characters. I know that a magical realism fic is going to play fast and loose with certain things. But stuff like laws and physical limitations without that handwaving I will often question because it doesn't make sense. Like a character taking children that are not hers out of the country without written permission of both parents = sooooo illegal. Or a 16 month old telling adults to 'get a room' which requires both the ability to vocalize that, the understanding that certain behaviors are sexual, and the ability to understand or desire discretion in the expression of said behaviors, I just don't buy it from my experience with kids. Kids IME don't develop that understanding until much much later. Or a baby born at 6 months gestation who needs little or no medical assistance, weighs 5lb at birth, gains a pound in 3 days, and goes home in two weeks is a baby that cannot possibly be human. I just expect that authors will treat as real the limitations and realities of the world in which their characters live. So if the character is written as Joe Normal human in this world that we live in, Joe Normal needs to obey physical and legal laws of the time and place in which they live or there really should be reasons given as to why they don't.

    I can be an absolutely frustrating AND aggravating reader, especially to a writer who doesn't know their subject materiel, doesn't know or care to do the research, or chooses not to find someone to beta-read for content and construction. It's not malicious, though. I really don't put my comments out there to tear an author down. Take from this what you will.

  • Jazter is absolutely right - Taylor is not eligible to stay in the US indefinitely. She would have entered the US on a student visa - which is specific to SSM. Once she left the school, she is not able to stay in the US. Now she could apply to go to another school in Pennsylvania, but this would take time and she would actually have to attend classes. And as a minor, she would have to have her parents sign the forms.

    As for the health insurance, one of the stipulations of obtaining a student visa is that there is proof of health insurance for the year. This insurance must cover potential pregnancy and newborn care. So at least her pregnancy would be covered.

    But that still doesn't deal with her ability to support herself. As someone on a student visa, she would not be able to work off campus. College students can work up to 20 hours/week, as long as it is on campus - but that is it. But in Taylor's situation, as a high school student, that wouldn't apply. And she isn't even at SSM anymore.

    The other thing I wonder about is the statutory rape laws in Pennsylvania. Each state is different but seeing as Taylor is only 16, and Giroux is 8 years older, this might prove to be a big legal problem for him.

    Not to mention that Sid will have more incentive to kill him!!
