Santa has to say, ''ha ha ha, merry Christmas!'' instead.

He appered in the states mainly after The Night Before Christmas came out and the red coat became popular after the Coca Cola comercials. He says ho,ho,ho because he is supposed to be living in the Laughing Valley of Hohaho.
In other words we created Santa's image so we can change it. I really don't think it matters if he says Ho,ho, ho or Ha, ha, ha. The spirit matters.
