Not unless they say it is. But if it's in their gallery as well, then there's a possibility they will be banned, or not allowed to post up pictures in their gallery anymore.

EDIT: I clicked on someone who was apparenlty her sister and the account isn't active. EDIT Number 2: There are at least 3 accounts that have commented on her profile that are inactive

If it really was her, wouldn't she have and use a picture without that on it? Are you talking about this profile? Because I stumbled on this girl, and it seems to fit what you're talking about.

You should report people who have pictures in their gallery that are not actually pictures of themself, regardless of whether they claim to be that person.
