    Yes, legally this is rape, because he was either told directly, or objectively had strong reasons to suspect, that you were not consenting (probably both, from what you've described), but proceeded anyway. It's rape and with the right evidence it can be prosecuted.

    When someone forces themself on you without your consent is what counts as rape. He really shouldn't have done it. You can have him arrested.

    Um, you said no and you were drunk. He wasn't drunk and ignored you. It's rape. Also, since you were so drunk at the time it's considered rape because he took advantage of someone who couldn't defend themselves. There's no reason for you to be ashamed about it. It wasn't your fault.
